At the same time, two members of parliament called for this decision to be reviewed, but on 10 January, the President of Parliament ordered the promulgation of this reform, which is supposed to facilitate the acquisition of title deeds (essential from January 2025 for <\/span><a href=\"https:\/\/envol-vert.org\/en\/news\/2024\/03\/peru-imported-deforestation-law\/\"><span style=\"font-weight: 400;\">all exports to the European Union<\/span><\/a><span style=\"font-weight: 400;\">). A few weeks later, the resistance continued! <\/span><span style=\"font-weight: 400;\">The director of SERFOR<\/span><span style=\"font-weight: 400;\"> (the forestry authority), Luis Alberto Gonz\u00e1les Z\u00fa\u00f1iga Guzm\u00e1n, alerted the deputy minister of agriculture to the risks of deforestation caused by the updating of Peru&#8217;s Forestry Law. On 1 February, <\/span><a href=\"https:\/\/news.un.org\/es\/story\/2024\/01\/1527437\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">UN rapporteur Francisco Cal\u00ed Tzay<\/span><\/a><span style=\"font-weight: 400;\"> warned of the dangers posed by this law for indigenous peoples\u2019 and territories\u2019. The approval of this law would represent a significant setback in our ongoing efforts to protect Peru&#8217;s Amazonian forests. We aim to clearly explain the reasons behind our stance:<\/span><\/p>\n<\/div><div class=\"fusion-title title fusion-title-1 sep-underline sep-solid fusion-title-text fusion-title-size-four\" style=\"--awb-margin-top:1.5%;--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:0px;--awb-margin-left-small:0px;\"><h4 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:16.8;--minFontSize:16.8;line-height:1.29;\"><div class=\"fusion-fa-align-left\"><i class=\"fb-icon-element-1 fb-icon-element fontawesome-icon fa-angle-double-right fas circle-no\" style=\"--awb-iconcolor:#ea773d;--awb-font-size:30px;--awb-margin-bottom:5%;\"><\/i><\/div>Safeguarding Our Forests and Wildlife: Exploring the Significance of Forest and Wildlife Law<\/h4><\/div><div class=\"fusion-text fusion-text-2\" style=\"--awb-text-transform:none;\"><p><span style=\"font-weight: 400;\">The Forest and Wildlife Law (<\/span><a href=\"https:\/\/sinia.minam.gob.pe\/normas\/ley-forestal-fauna-silvestre-ndeg-29763-sus-reglamentos\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Law No. 29763<\/span><\/a><span style=\"font-weight: 400;\">) in Peru establishes that forest zoning must be approved by the Ministry of the Environment (MINAM), responsible for ensuring the sustainability of natural resources. This law defines the uses of forest lands, taking into account technical, social, and economic aspects. To obtain land ownership, it is necessary to request authorization that determines the primary use of each plot, such as agriculture, forest conservation, protected areas, etc. Currently, land ownership can only be granted if the primary use is known, and there are rules governing any subsequent modifications.<\/span><\/p>\n<\/div><div class=\"fusion-title title fusion-title-2 sep-underline sep-solid fusion-title-text fusion-title-size-four\" style=\"--awb-margin-top:1.5%;--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:0px;--awb-margin-left-small:0px;\"><h4 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:16.8;--minFontSize:16.8;line-height:1.29;\"><div class=\"fusion-fa-align-left\"><i class=\"fb-icon-element-2 fb-icon-element fontawesome-icon fa-angle-double-right fas circle-no\" style=\"--awb-iconcolor:#ea773d;--awb-font-size:30px;--awb-margin-bottom:5%;\"><\/i><\/div>Obscure Motivations Behind Forest and Wildlife Law Modification<\/h4><\/div><div class=\"fusion-text fusion-text-3\" style=\"--awb-text-transform:none;\"><p><span style=\"font-weight: 400;\">The proposed amendment to the Forest Law aims to promote development through forest zoning in different regions of the country. This amendment proposes to include an additional provision to modify the current classification regime of lands based on their primary use, as well as the rules allowing land use changes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the current law, the approval of forest zoning falls under the jurisdiction of the Ministry of the Environment (MINAM), responsible for ensuring the sustainability of natural resources in Peru. However, with the proposed modification, the Ministry of Agrarian Development and Irrigation (MIDAGRI) would become responsible for validating forest zoning.<\/span><\/p>\n<\/div><div class=\"fusion-title title fusion-title-3 sep-underline sep-solid fusion-title-text fusion-title-size-four\" style=\"--awb-margin-top:1.5%;--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:0px;--awb-margin-left-small:0px;\"><h4 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:16.8;--minFontSize:16.8;line-height:1.29;\"><div class=\"fusion-fa-align-left\"><i class=\"fb-icon-element-3 fb-icon-element fontawesome-icon fa-angle-double-right fas circle-no\" style=\"--awb-iconcolor:#ea773d;--awb-font-size:30px;--awb-margin-bottom:5%;\"><\/i><\/div>Endangered Amazon Forests: The Detrimental Consequences of Legislative Changes<\/h4><\/div><div class=\"fusion-text fusion-text-4\" style=\"--awb-text-transform:none;\"><p><span style=\"font-weight: 400;\">MIDAGRI, which is responsible for the development and promotion of agricultural and livestock activities in Peru, does not comprehensively consider biodiversity and ecosystems. In the Peruvian Amazon region alone, approximately <\/span><a href=\"https:\/\/cdn.www.gob.pe\/uploads\/document\/file\/12149\/04_plana_2011_al_2021.pdf?v=1530548814\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">9 million hectares<\/span><\/a><span style=\"font-weight: 400;\"> have been deforested to expand agricultural land. Without an entity responsible for forest protection and conservation promotion, forest zoning would be limited to production criteria.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Granting land titles without prior evaluation or study would pave the way for agricultural expansion over forests. This change in land use would equate to deforestation, resulting in approximately <\/span><a href=\"https:\/\/sinia.minam.gob.pe\/documentos\/segunda-comunicacion-nacional-peru-convencion-marco-las-naciones\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">150,000 hectares lost annually<\/span><\/a><span style=\"font-weight: 400;\">. Without a technical study, the right to convert forest areas into agricultural land would be granted.<\/span><\/p>\n<\/div><div class=\"fusion-title title fusion-title-4 sep-underline sep-solid fusion-title-text fusion-title-size-four\" style=\"--awb-margin-top:1.5%;--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:0px;--awb-margin-left-small:0px;\"><h4 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:16.8;--minFontSize:16.8;line-height:1.29;\"><div class=\"fusion-fa-align-left\"><i class=\"fb-icon-element-4 fb-icon-element fontawesome-icon fa-angle-double-right fas circle-no\" style=\"--awb-iconcolor:#ea773d;--awb-font-size:30px;--awb-margin-bottom:5%;\"><\/i><\/div>Threats to Indigenous Peoples and Violations of Rights: An Alarming Situation<\/h4><\/div><div class=\"fusion-text fusion-text-5\" style=\"--awb-text-transform:none;\"><p><span style=\"font-weight: 400;\">Indigenous peoples are vulnerable and could see their lands affected. The law allows for the formalization of land titles in all untitled areas. Several indigenous territories currently in the process of formalization could be impacted by the presence of individuals owning land and engaging in agricultural activities. Modifying the forest law would facilitate <\/span><a href=\"https:\/\/dar.org.pe\/normas-que-impactan-bosques-analisis-de-la-reciente-norma-que-debilitaria-la-ley-forestal-y-de-fauna-silvestre\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">land trafficking in the Amazon<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Indigenous peoples have not been consulted at any point (unlike their participation in the creation of the forest law). Furthermore, as explained in a <\/span><a href=\"https:\/\/envol-vert.org\/es\/actualidades\/2022\/07\/acuerdo-escazu-peru\/\"><span style=\"font-weight: 400;\">previous article<\/span><\/a><span style=\"font-weight: 400;\">, Peru has not ratified the Escaz\u00fa Agreement. This agreement aims to ensure access to information and citizen participation in environmental matters, thereby strengthening the role of indigenous populations. Modifying the forest law would be an additional action that ignores the rights of indigenous communities and limits their ancestral role in the conservation of the Amazon forest.<\/span><\/p>\n<\/div><div class=\"fusion-title title fusion-title-5 sep-underline sep-solid fusion-title-text fusion-title-size-four\" style=\"--awb-margin-top:1.5%;--awb-margin-top-small:0px;--awb-margin-right-small:0px;--awb-margin-bottom-small:0px;--awb-margin-left-small:0px;\"><h4 class=\"fusion-title-heading title-heading-left fusion-responsive-typography-calculated\" style=\"margin:0;--fontSize:16.8;--minFontSize:16.8;line-height:1.29;\"><div class=\"fusion-fa-align-left\"><i class=\"fb-icon-element-5 fb-icon-element fontawesome-icon fa-angle-double-right fas circle-no\" style=\"--awb-iconcolor:#ea773d;--awb-font-size:30px;--awb-margin-bottom:5%;\"><\/i><\/div>Incoherent Modification Contradicting International Agreements and Treaties<\/h4><\/div><div class=\"fusion-text fusion-text-6\" style=\"--awb-text-transform:none;\"><p><span style=\"font-weight: 400;\">Starting in 2024, a new European zero-deforestation regulation will come into effect, aiming to limit the importation of agricultural raw materials from deforested plots after 2020. This poses a major challenge for Peru and several producing countries. Opening up the possibility of expanding agricultural areas into Amazonian territories would weaken Peru&#8217;s image in the international trade scene.<\/span><\/p>\n<h3><b>Chronology<\/b><\/h3>\n<\/div><ul style=\"--awb-iconcolor:#ea773d;--awb-line-height:23.8px;--awb-icon-width:23.8px;--awb-icon-height:23.8px;--awb-icon-margin:9.8px;--awb-content-margin:33.6px;\" class=\"fusion-checklist fusion-checklist-1 fusion-checklist-default type-icons\"><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon fa-angle-right fas\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">On November 5, 2021, Bill 649\/2021-CR, aimed at amending the Forest and Wildlife Law (Law 29763) and incorporating transitional provisions on the limits of permanent production forests, was introduced.<\/div><\/li><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon fa-angle-right fas\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">On July 14, 2022, the substitute text for Bills 649\/2021-CR and 894\/2021-CR was approved in the first reading, with 5 votes against, 103 votes in favor, and 0 abstentions. Subsequently, it was exempted from a second reading, maintaining the same number of votes. However, the autograph received criticism.<\/div><\/li><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon fa-angle-right fas\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">On November 23, 2022, the insistence report was issued due to the observations of the President of the Republic regarding the autograph of Bill 649\/2021-CR, 894\/2021-CR, and 2315\/2021-CR.<\/div><\/li><li class=\"fusion-li-item\" style=\"\"><span class=\"icon-wrapper circle-no\"><i class=\"fusion-li-icon fa-angle-right fas\" aria-hidden=\"true\"><\/i><\/span><div class=\"fusion-li-item-content\">On March 23, 2023, during the plenary session of Congress, a vote was held rejecting the insistence report aimed at amending the Forest and Wildlife Law, with 51 votes against, 49 votes in favor, and 11 abstentions. However, after this vote, deputies Nilza Chac\u00f3n and Elvis Vergara submitted requests for reconsideration to reopen the debate on this controversial modification.<\/div><\/li><\/ul><div class=\"fusion-separator fusion-full-width-sep\" style=\"align-self: center;margin-left: auto;margin-right: auto;margin-top:1.5%;margin-bottom:1.5%;width:100%;\"><div class=\"fusion-separator-border sep-single sep-solid\" style=\"--awb-height:20px;--awb-amount:20px;--awb-sep-color:rgba(224,222,222,0);border-color:rgba(224,222,222,0);border-top-width:1px;\"><\/div><\/div><div class=\"fusion-text fusion-text-7\" style=\"--awb-text-transform:none;\"><p><strong>As a society, it is crucial that we become aware of the importance of preserving our environment and work together to protect our natural resources. It is now time to decide whether we want to build a sustainable future or destroy the remnants of our precious ecosystems. Envol Vert joins other civil society organizations and eminent authorities such as the Ministry of the Environment (MINAM), the Forest and Wildlife Service (SERFOR), the Ministry of Agrarian Development and Irrigation (MIDAGRI), and the Ombudsman in firmly expressing our opposition to these legislative proposals that would have a severe impact on the Peruvian Amazon forest and its communities. We demand that any consideration of amending the Forest and Wildlife Law be completely dismissed.
